Terms of Service

These terms govern your use of ApplyHere as an employer ("you", "your company"). ApplyHere is a service that receives job applications on your behalf, organises them, and helps you triage candidates. By creating an account or using the service, you agree to these terms.

1. What ApplyHere does, and what it doesn't

ApplyHere is a tool. It routes incoming CVs to your dashboard, produces an AI-generated summary matching the CV against the role you posted, and lets you move candidates through stages. You review each application. You decide who to shortlist, interview, reject, or hire.

ApplyHere does not make hiring decisions for you. The AI summary is a triage aid — it does not score, rank, or recommend candidates. You are solely responsible for the hiring decisions your company makes using ApplyHere.

2. Your responsibilities under New Zealand law

When you use ApplyHere, you agree that your recruiting practices — and your use of this service — will comply with all applicable New Zealand law, including:

  • The Privacy Act 2020. You are the "agency" that determines the purpose of collecting applicant information. You must have a lawful reason to collect, use, and retain it.
  • The Human Rights Act 1993 and Employment Relations Act 2000. You must not discriminate against applicants on any prohibited ground (age, sex, ethnicity, disability, religion, family status, sexual orientation, etc.) either directly or indirectly.
  • The Fair Trading Act 1986. Job postings you route through ApplyHere must be accurate — the role, company, location, and terms you describe must be real.
  • The Unsolicited Electronic Messages Act 2007. You must not use ApplyHere to send bulk messages to people who did not apply.

You alone are responsible for complying with these laws. ApplyHere is not your legal advisor.

3. Acceptable use

You agree not to:

  • Post fake, misleading, or illegal job listings
  • Use the AI summary as your sole basis for rejecting an applicant
  • Reject applicants on any prohibited discriminatory ground
  • Export, resell, or share candidate data outside your hiring process for this role
  • Attempt to identify candidates who have used the self-service deletion link
  • Upload content you don't have the right to use, or use ApplyHere to harass anyone
  • Probe, reverse-engineer, or attempt to bypass the platform's security controls
  • Resell, sublicense, or provide the service to third parties as your own

4. Data protection — controller / processor relationship

For every applicant who emails a CV to a role you've posted:

  • You are the data controller. You decide the purpose (assessing the applicant for the role) and how long to consider them.
  • ApplyHere is the data processor. We receive, store, and present the application to you on your instruction.

ApplyHere retains applications for 60 days, then deletes them automatically. You can delete an application earlier by removing it from your dashboard. Candidates can delete their own applications using the personal link in our auto-reply. Our privacy policy explains how this works for candidates; a Data Processing Agreement is available on request.

5. Fees and billing

The core ApplyHere service is currently free. We may introduce paid features or add-on services in future — for example, higher application volumes, additional integrations, or premium support. If we do, pricing and billing terms will be shown clearly before you opt in, and you'll never be auto-enrolled in a paid plan.

Where a paid service does apply, it's billed through Stripe in the currency and at the rate shown on your dashboard at the time you subscribe. You can cancel any paid service at any time from your dashboard. We don't refund partial billing periods, but you keep access until the end of the period you've already paid for.

We may change pricing for future billing periods with at least 30 days' notice by email. If you don't accept the new price, you can cancel before it takes effect.

6. Termination by you

You can close your account at any time. We'll export your active data on request, then delete all of your company's data — including all stored candidate applications — within 30 days of closure.

7. Termination by us — for cause

We may suspend or terminate your account immediately and without refund if, in our reasonable judgement, you have:

  • Used ApplyHere to discriminate against applicants on a prohibited ground
  • Posted fraudulent, misleading, or unlawful job listings
  • Harassed, intimidated, or retaliated against an applicant
  • Violated the Privacy Act 2020 using our platform, or failed to respond to lawful applicant requests
  • Attempted to compromise the security of our systems or the privacy of other customers
  • Failed to pay fees when due, after written notice
  • Breached these terms in any other material way

For breaches that can be cured, we'll usually give you written notice and a reasonable period to fix the problem before termination. For serious breaches — particularly discrimination, fraud, or security violations — we may terminate immediately.

Upon termination for cause, your access ends at once. We will retain applicant data only as long as needed to respond to any regulatory investigation, then delete it within 60 days. We are not liable for consequences of termination where you are in material breach.

8. Regulatory cooperation

If the Office of the Privacy Commissioner, the Human Rights Commission, or another New Zealand regulator contacts us about your use of ApplyHere, we'll cooperate with them. We'll tell you when we reasonably can, unless the law prevents us from doing so.

9. Warranties and liability

ApplyHere is provided on an "as is" basis. We work hard to make it reliable — we verify applications land cleanly, alert you if a CV couldn't be parsed, and send auto-replies so candidates know their application was received — but we don't warrant that the service will be uninterrupted or error-free.

The AI-generated summaries are produced by a large language model and may contain errors. You must review the actual CV and email before making hiring decisions. We do not warrant the accuracy, completeness, or suitability of AI outputs for any purpose.

To the maximum extent permitted by law, our total liability to you for any claim arising out of the service is capped at the fees you paid us in the one month immediately preceding the claim. Where the service has been provided to you free of charge, our total liability is capped at NZ$100. We are not liable for indirect, consequential, or incidental damages. Nothing in these terms limits your rights under the Consumer Guarantees Act 1993 where it applies.

10. Indemnity

You agree to indemnify ApplyHere against any claim, loss, or expense arising from:

  • Your hiring decisions and recruiting practices
  • Your breach of applicable law, including Privacy Act and Human Rights Act claims
  • The content of job listings you publish through the service
  • Your breach of these terms

11. Intellectual property

ApplyHere's software, branding, and content are ours. Applications and CVs you receive remain the property of the candidate — you hold them under the licence implied when the candidate emails them to you for consideration. Your job descriptions remain yours.

12. Changes to these terms

We'll update these terms as the product evolves. Material changes — like new obligations for customers, or new termination reasons — will be emailed to the account owner with at least 30 days' notice. Continued use after the notice period means you accept the change.

13. Governing law and disputes

These terms are governed by the laws of New Zealand. The courts of New Zealand have exclusive jurisdiction over any dispute arising out of or relating to the service. Before starting a formal dispute, we agree to attempt resolution by good-faith discussion — email hello@applyhere.co.nz first.
